The Threats

Because of these threats he has made, he was arrested on May 1, 2024 and charged with six counts of “Use or Threatened Use of Explosive Material” and one count of “Interstate Communication of Threats", according to the court filing. The case revolves around multiple claims and posts Larson has made in 2023 and 2024. While he probably would have never actually realized his threats, they nonetheless caused harm. In one case, authorities responded to a reported bomb threat by Larson at a facility in Colorado, evacuating the building and conducting a full sweep. No explosives were found but operations were affected for hours.

Trial

On May 10, 2024, nine days after his arrest, a hearing took place to decide what to do with Larson. The Judge ordered Detention for the influencer, the reason being his mental state and homelessness.

Mr. Larson appears to have mental health issues. He has been homeless for years, and it was represented by counsel that he makes some money from his internet posting and may receive social security benefits. He is unemployed and has no stable place to live.

So Larson had to stay in custody for the duration of his trial.

Now, two years later, the Influencer has entered a guilty plea on April 9 according to court documents. He admitted to one count of transmitting threats in interstate commerce. In exchange, the government agreed to dismiss the multiple other counts. Also, prosecutors will not oppose a request for a sentence of time served, making the two years he has spent in custody count towards his punishment. For it, Larson waived most of his rights to appeal or challenge the conviction and sentence and has agreed to forfeit any property and evidence tied to the case like his cell phone.

The estimated time Larson will probably have to serve is between 27 and 33 months.

The decision will be up to the judge in the end. Some people even question if he should be put on trial and in jail given his mental health problems. His court dates were cancelled once before in 2024 due to him being determined not fit to stand trial – so why should he now be? He acknowledged making the decision to plead guilty voluntarily, but is he actually capable of making informed legal decisions? With his history and constitution Daniel might profit more from a stay in a psychiatric facility than a trial with a prison sentence. We will have to wait and see what the judge decides.
